NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. OPEN ONLY TO ELIGIBLE LEGAL RESIDENTS OF THE “LOWER 48” OF THE UNITED STATES (EXCLUSIVE OF HAWAII AND ALASKA) AND THE DISTRICT OF COLUMBIA WHO, AS OF THE TIME OF SUBSCRIPTION, ARE AT LEAST 18 YEARS OLD. VOID IN ALL JURISDICTIONS OTHER THAN THOSE STATED ABOVE AND WHERE PROHIBITED OR RESTRICTED BY LAW.

2. Eligibility
The Giveaway is open only to individuals who (i) are eighteen (18) years of age or older at the time of subscription and (ii) are legal residents of the “lower forty-eight (48)” United States (exclusive of Hawaii and Alaska), the District of Columbia. Void in all jurisdictions other than those stated above and where prohibited or restricted by law. The following individuals are not eligible to enter or win a prize: employees, contractors, representatives, agents, directors, and officers of Bonanza Boots and its affiliated companies, marketing agencies, and any other parties involved in the administration of the Giveaway (Bonanza Boots, collectively with the foregoing, the “Giveaway Parties”) and each of the immediate family members of such excluded Giveaway Parties (i.e., spouses, parents, children, siblings and the “steps” of each) and all persons living in the same household of each. By participating in this Giveaway, participants agree to be bound by these official rules (“Official Rules”) and by the decisions of Bonanza Boots which shall be final in all matters relating to the Giveaway. Winning a prize is contingent upon fulfilling all requirements set forth herein.

3. Giveaway Period
The Giveaway begins and ends at Bonanza Boots’ discretion, as advertised on Bonanza Boots' website.

4. How to Enter
To be eligible for the Giveaway, you must subscribe to text message notifications from Bonanza Boots, submit the Giveaway enrollment form located on the Bonanza Boots website, and remain subscribed when a Selection (defined below) is made (the “Giveaway Eligibility Period”). YOU WILL NOT BE ELIGIBLE TO PARTICIPATE IN THE GIVEAWAY UNLESS YOU COMPLETE AND SUBMIT THE ENROLLMENT FORM ON THE BONANZA BOOTS WEBSITE. By subscribing to text message notifications and entering the Giveaway, you agree to these Official Rules, our Website Terms of Use and our Privacy Policy. Message and data rates may apply, and Bonanza Boots is not responsible for any fees incurred by an participant in connection with the Giveaway. Although you must remain subscribed to text message notifications when a Selection is made, you can opt out of receiving text messages and other direct marketing communications in accordance with the instructions provided by Bonanza Boots.
Compliance with the eligibility requirements will be determined by Bonanza Boots in its sole discretion. Subscriptions that violate these eligibility requirements will be disqualified. By subscribing to text message notifications and submitting the Giveaway enrollment form located on the Bonanza Boots website, you affirm that you have read, understand and agree to these Official Rules and our Privacy Policy. Participants understand that subscribing authorizes Bonanza Boots to deliver or cause to be delivered, to the phone number provided, text messages via automatic delivery means. Any questions, comments or complaints regarding this Giveaway or Bonanza Boots’ text messages should be directed to Bonanza Boots at the address listed above.
The Giveaway requires a two-way text message capable wireless device. Participant must be the authorized account holder of the phone number used to enter the Giveaway. The “authorized account holder” is defined as the natural person to whom the phone number is assigned by a wireless carrier that is responsible for maintaining and operating the phone number. In the event of a discrepancy between the identity of the authorized account holder, the “winner,” and the participant, Bonanza Boots reserves the right, in its sole discretion, to declare the Selection invalid and make an alternate Selection.

5. Winner Selection and Notification
Potential winners will be randomly selected, at Bonanza Boots sole discretion, from among all eligible entries at the time a winner is selected (the “Selection”). Selection(s) will occur at the time and date, and with the frequency, as Bonanza Boots determines in its sole discretion. Bonanza Boots may make multiple Selections in its sole discretion and may also make a Selection at any time or at no time. Each potential winner will be contacted via the phone number used to subscribe to text message notifications on or following the time of the Selection. The potential winner may be required to provide identification sufficient to show that he/she is the authorized account holder of the phone number, in Bonanza Boots sole discretion. The contact notification will include instructions on how to claim the Prize (defined below). If any winner is found to be ineligible, or not in compliance with these Official Rules, declines to accept a Prize, if Bonanza Boots is unable to contact a winner within seventy-two (72) hours of attempting contact, or in the event that a Prize notification or Prize is returned undeliverable, the Prize may be forfeited. Potential Prize winners may be required to furnish proof of identification and sign, complete, and return an Affidavit of Eligibility/Liability Release and, where lawful, a Publicity Release, within three (3) days of attempted notification or prize may be forfeited. In the event that a potential winner is disqualified for any reason, Bonanza Boots reserves the right to award the Prize to an alternate Selection.

6. Odds of Winning
Odds of winning depend on the number of eligible subscribers at the time of a Selection.

7. Prizes and Prize Claims
One (1) monthly pair of leather boots from Bonanza Boots is available (“Prize”). The approximate retail value of each Prize is $200.00 or less.

The Prize is non-transferable and cannot be redeemed or exchanged for cash. No Prize substitution is permitted, except at the sole discretion of Bonanza Boots. If Prize or component of the Prize is unavailable or cannot be awarded for any reason, Bonanza Boots reserves the right in its sole discretion to substitute a Prize or component with one of comparable or greater retail value.
The Prize carries no warranty. Bonanza Boots has neither made nor is responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to the Prize.
The winners are solely responsible for all federal, state, local, or other applicable taxes associated with the acceptance and use of a Prize. All costs and expenses associated with Prize acceptance and use not specifically provided herein are the responsibility of the winners (including any travel necessary for use of the Prize).

8. Publicity
Except where prohibited by law, by accepting a Prize, the winner hereby grants Bonanza Boots and its licensees a perpetual, worldwide, royalty-free, non-exclusive and sub-licensable right and license to use, distribute, and publicly display the winner’s name, hometown, and likeness in any way, at any time, in any and all media, including for use in advertising and marketing, without limitation, without any additional approval or consideration.

9. Limitations of Liability of Giveaway Parties
The Giveaway Parties assume no liability and are not responsible for, and by entering the Giveaway you hereby waive and release the Giveaway Parties from, any actions, claims, damages, losses or injuries of any kind (collectively “Claims”) arising in connection with the Giveaway and/or the receipt, use or misuse of any Prize.
In the event of any ambiguity or error(s) in these Official Rules, Bonanza Boots reserves the right to clarify or modify these Official Rules however it deems appropriate to correct any such ambiguity or error(s) by posting an updated set of Official Rules on the Bonanza Boots website. The rules applicable to a Selection will be those that are publicly posted at the time of the Selection. In no event will more than one Prize be awarded to a winner.
Bonanza Boots may prohibit a participant from participating in the Giveaway or winning the Prize if, in its sole discretion, it determines that said participant is attempting to undermine the legitimate operation of the Giveaway by cheating, deception, or other unfair playing practices.

10. Bonanza Boot’s Reservation of Rights
If the Giveaway is not capable of running as planned for any reason, including, without limitation, due to a force majeure event or infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes which corrupt or affect the administration, security, fairness, integrity, or proper conduct of the Giveaway, Bonanza Boots reserves the right, at its sole discretion, to modify, suspend, or cancel the Giveaway or refuse to make a Selection.

11. Governing Law
All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, the rights and obligations of participants and winners, and the rights and obligations of the Bonanza Boots in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of State of California, without giving effect to any choice of law or conflict of law rules. Bonanza Boots’ failure to enforce any term of these Official Rules shall not constitute a waiver of that or any other provision. If any provision of these Official Rules is held to be invalid or unenforceable, such provision shall be struck, and the remaining provisions shall be enforced.

12. Privacy
Any personal information collected during a participant’s participation in the Giveaway (including a participant’s phone number) will be collected and used by Bonanza Boots and its designees for the administration and fulfillment of the Giveaway and as otherwise described in these Official Rules and Bonanza Boots’ Privacy Policy. Your phone number and any other personal information you provide will only be used as provided in Bonanza Boots’ Privacy Policy. If you are selected as a winner, your information may also be included in a publicly available winner’s list.
